Byram Township Zoning Process

General Information:

  • - Byram Township Chapter 240 – Zoning, covers various aspects of zoning requirements for residential and commercial properties. 
  • - No construction permit or other permits for the use of land or buildings shall be issued until a zoning permit has been secured from the Zoning Officer.

 Zoning permits are required for many items including:  

  • A) Accessory structures such as sheds, fences, decks, additions, swimming pools, oil and propane tanks, HVAC systems, etc.
  • B) New home construction
  • C) Driveways
  • D) Other items that may not fall into accessory structure or new construction categories

CONTACT THE ZONING OFFICER TO DETERMINE IF A ZONING PERMIT IS REQUIRED.

  • - Zoning Permit must be filled out completely with all relevant information including owner of property, address, block/lot, zone, email and phone, dimensions, distances to side, rear, and front property lines. 
  • - In the case of significant home additions, etc., plans by a licensed architect or engineer must be included.
  • - Application must include a survey or plot plan that illustrates the location of the proposed zoning request.  If you need to get a new survey, it must be done by a licensed land surveyor.
  • - A $50 zoning permit fee should be made payable to “Byram Township”
  • Township Zoning permits shall be granted or denied within 10 business days, after it has been determined a complete zoning permit application has been submitted.

CHANGES IN FIRE PREVENTION SERVICES IN BYRAM TOWNSHIP

 

Effective January 1, 2017 the Township of Sparta and the Township of Byram entered into a Shared Services Agreement for the services of smoke detector/carbon monoxide alarm and portable fire extinguisher compliance inspections.  As part of this arrangement, Sparta will also be handling life and non-life hazard inspections for commercial establishments in accordance with the Uniform Fire Safety Act, P.L. 1983, C. 383.

 All fees related to the inspections of and permits issued for properties in Byram Township will be paid directly to the Township of Sparta.  Fees are outlined in Sparta's Ordinance 16-1.8 and 16-1.9.  To schedule an inspection, please call Sparta Fire Prevention at 973-729-4227.

 As done in the past, smoke detector inspections will be conducted one day per week.   If there are no open permits in the Construction Office, the certificate will be issued on site at the time of inspection.   If open permits exist, contact Byram Construction office at 973-347-2500 x123 to close out the permits.

The Township Manager is the chief executive and administrative official of Byram Township, as provided in N.J.S.A. 40:69A-95.  The Office of the Manager shall include the following functions:

A. Budget.

B. Personnel.

C. Disaster control and emergency management.

D. Local public assistance.

E. Such others as may be assigned from time to time by the Township Council.

The Township Manager prepares the budget, appoints and removes department heads, other officers, subordinates and assistants. He oversees the day-to-day workings of the township. He negotiates contracts for Byram Township. He also attends Council meetings where he may participate in discussions, but not vote on issues.

The following shall be the Township administrative organization. Each office and department shall be under the direction and control of the Manager:

A. Offices of Manager and Clerk.

B. Offices of Attorney and Engineer, whether as employees or as professional contractors.

C. Municipal Court.

D. Finance Department.

E. Police Department.

F. Public Works Department.

G. Office of Planning and Development.

H. Fire Department.

I. Recreation Department

J. Rescue Squad. 

The position of Municipal Clerk, also commonly known as Township Clerk, is governed by State Statute.  The position requires appointment by the governing body, and ultimately must be held by a Registered Municipal Clerk, a state issued certification following successful completion of specific coursework and exam.

The role of Municipal Clerk is one of significant responsibility and diversification.  The principal or "core" duties of a Municipal Clerk are defined by State Statute as the following:

  • Secretary to the Governing Body
  • Secretary to the Municipal Corporation
  • Election Administrator and Registrar of Voters
  • Administrative and Licensing Officer
  • Custodian of Records

These "core" duties encompass a myriad of State Statues and include interaction with all levels of government, federal, state, county, and local, most municipal departments, local organizations, and residents.  Each one of the aformentioned duties includes numerous responsibilities and tasks that are undertaken by the Municipal Clerk and staff.

As Secretary to the Governing body (Township Council), the Municipal Clerk attends all Council meetings; records minutes; assists in preparing the Council meeting agenda and resolutions; compiles meeting packets, receives bids and RFP's; administers and records Oaths of Office; processes correspondence and records, files and advertises ordinances and acts as a liaison between the public and governing body.

The Municipal Clerk, as Secretary to the Municipal Corporation, signs official documents, has custody of the Township Seal and atttests the signature of the Mayor and other Township officials.

As Election Official, the Municipal Clerk handles voter registration, accepts petitions for vacancies in local elected offices, furnishes materials for local, primary and general elections, selects polling areas and calculates and maintains custody of election results.

The Municipal Clerk also issues various licenses, i.e. Peddler / Solicitor, Bingo, Raffle, Liquor, Limo, etc.; furnishes data to the public, provides copies of Ordinances, Resolutions and other information requested by the public and personnel.

Additionally, the Municipal Clerk's Office is often referred to  as the doorway to the community because of the diversification of the position, and often serves a direct link between the municipality's residents and local government.  If the Municipal Clerk is unable to directly assist you, be assured that you will be referred to the appropriate party or pointed in the right direction.

It is the responsibility of the Registrar of Vital Statistics to record all births, deaths and marriages occurring within the Township of Byram.  The accumulation of information from vital records provides data about the events that occur throughout the entire State of New Jersey.  In addition, the Registrar is also responsible for issuing marriage licenses, marriage certificates, birth certificates and death certificates.  The Registrar hours are 8:30am-4:30pm Monday - Friday.

Tax Assessment The Tax Assessor is a quasi-judicial position, a creature of the Legislature, whose authority is statutory and based in the New Jersey Constitution. The Byram Township Tax Assessor holds a Certified Tax Assessor Certificate from the State of New Jersey, Department of the Treasury, Division of Taxation. Although the Tax Assessor is hired and paid by the Municipality, the immediate supervisor of the Tax Assessor is the County Board of Taxation.

The Assessor's Office The municipal Tax Assessor is responsible for the following activities:

  • Location and ownership of all real property in the taxing district; listing and describing property in a manner as prescribed by the Division of Taxation.
  • Determining taxable value of all property in the taxing district.
  • Equalization via district wide revaluation and maintenance and for purposes of State aid to schools.
  • Defense of Appeals - appearances at County Tax Board and State Tax Court.
  • Process and review copies of construction permits and valuation for added and omitted assessments and for COAH fees.
  • Sub-Divisions - assign block and lot numbers and valuation of newly created lot(s).
  • Farmland assessment - valuation, review of applications, inspections, in addition to rollback assessments.
  • Continual Review of Property Cards to ensure accuracy.
  • Deductions - review for qualification pursuant to NJ State Statutes of Veteran, widow, senior & disabled.
  • Exempt Properties - Every third year reviewing all exempt properties and obtaining updated information to ensure qualification.
  • Chapter 75 - Assessment notification post cards mailed annually on or before February 1st of the tax year. The notification shows the current year assessment, the taxes paid in the prior year, and appeal information. If taxpayers have any questions with regard to the assessment, they should contact the Tax Assessor's office.

Tax Appeals A taxpayer does not file an appeal of his/her taxes but rather the assessment. Byram Township taxpayers who believe that their assessments do not reflect 100% of true market value as of October 1st, of the pretax year (the assessing date) have the right to file an appeal with the Sussex County Board of Taxation.  Please contact the County Board of Taxation to obtain the due date. Properties with an assessed value in excess of $1,000,000 may file an appeal directly to the State Tax Court. However, all property owners are urged to speak with the Tax Assessor to discuss their assessment prior to filing an appeal. FARMLAND INFORMATION

The New Jersey Farmland Assessment Act of 1964 permits farmland and woodland acres that are actively devoted to an agricultural or horticultural use to be assessed at their productivity value.   In addition to meeting certain applicability criteria, the owner must annually apply for Farmland Assessment on Form FA-1 with the municipal tax assessor on or before August 1 of the year immediately preceding the tax year.   Click the below links for additional information as well as the state required forms.

Fire Inspection Requirements for Home Sale or Change of Occupancy:

Uniform Fire Code requires before the change of occupancy (home sale or change of renter), the owner shall obtain a Smoke Detector Carbon Monoxide Alarm Certificate (CSDCMAC) in any 1-family or 2-family dwelling unit and also in apartment units.

If you live in a home, the homeowner/realtor is responsible for scheduling an inspection.

If you live in an apartment, the management company is responsible for scheduling and inspection.

  • Smoke detector exists on each level, including basements; (excluding attic and crawl space); and
  • Smoke detector and carbon monoxide alarm outside each separate sleeping area; and within 10 feet of bedrooms; and
  • All smoke detectors are in working order; and
  • Carbon monoxide alarm(s) in working order; and
  • Fire extinguisher is the correct size, is properly mounted, and is located within 10 feet of the kitchen.

  • Inspections are completed on Wednesday only between 10:00 AM and 12:00 PM.

 Fees:
